TERMS AND CONDITIONS

GENERAL NOTES

Hallmark Adventure Travel, hereafter referred to as HAT accepts payment by credit card, bank draft or cash. All costs and prices indicated are for land services and do not include international airfare. Land costs are based on double occupancy and are priced per person. Single supplements apply to anyone wishing to have their own room but a single room cannot be guaranteed.

All prices are subject to change at any time due to currency fluctuations, or other circumstances beyond HAT a min of 4 participants for a guarantees departure, we have attempted to indicate this. Please check with us for minimums and availability.

Safaris are booked and confirmed only on receipt of a 40% deposit of the basic program rate and the on acknowledgement of the same. When HAT receives the deposit, a booking packet and invoice will be mailed to you. Balance of payments is due no later than sixty days prior to the commencement of your trip. If the balance has not been received by that date HAT shall be entitled at its discretion, to treat your reservation as cancelled and consequently you shall forfeit such part of the deposit as determined (please see cancellation and refunds below).


LATE BOOKING RUSH CHARGE

This refers to any reservation made within 45 days of commencement of a safari. This may be accepted provided space is available, payment in full has been received and required documents can be delivered prior to departure. There is a rush charge of $100 per booking under these circumstances. HAT will provide necessary travel documents three weeks prior to scheduled departure on bookings made not later than 60 days prior to scheduled departure. For late booking, however, documents shall be provided within a reasonable time frame.


CANCELLATIONS & REFUNDS

Any cancellation of a booking must be in writing and shall be only effective upon its acknowledged receipt by HAT. Refunds will be given minus cancellation charges as follows:

  • Minimum fee of $150 per person
  • More than 65 days prior to departure 35%of total cost
  • 31-65 days prior to departure 50% of total cost
  • 1-30 days prior to departure 100% of total cost

Different cancellation policies apply at different camps or safaris and may be less or more. On group or custom safaris there may be stricter cancellation policies - please inquire.

No refunds are given for lost travel time or substitution of facilities, for itineraries amended after departure or for circumstances arising beyond HAT control. If you do not appear for any accommodation, service, sightseeing, or trip segment; or if you leave your program after it has begun, miss scheduled sightseeing activities, meals, or accommodations- there will be no refund.

HAT reserves the right to cancel any departure, itinerary, or any part of it, to make such alterations in the itinerary as it deems necessary, to refuse to accept or retain as a member of any program any person at any time, and to pass on to program members we expenditure occasioned by delays or events beyond its control. HAT reserves the right to substitute hotels and services for those mentioned in detailed itineraries when necessary.


GENERAL INFORMATION

All bookings are accepted by HAT as an independent ground tour operator and also as an agent for hotels, airlines, car hire and bus companies, grounds transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation and/or other services. These services provided by the independent companies are offered subject to the terms and conditions contained in the tickets, exchange orders and/or vouchers issued by them and/or their suppliers. Because HAT does not have the right to control the operations of the independent operators and their suppliers, it will not be held liable for any personal injury or property damage, which may arise out of these services. In case of any appreciable variation in its cost, HAT reserves the right to adjust its rates.


INSURANCE

HAT strongly recommends that you obtain the following types of insurance, at your domicile before you start your safari. Accidental death and disability; Life insurance; Emergency medical evacuation; Trip cancellation, Major medical, Loss of personal effects.


TRAVEL DOCUMENTS & PERMITS VACCINATIONS

It is the clients responsibility to ensure that passports, visas, travel health certificates, inoculations, international driving license, or other documentation required for the trip are obtained and are in order. It is your responsibility to meet any additional costs incurred either by yourself (or by HAT on your behalf) as a result of any failure by you to comply with such requirements.

All information given in this information bulletin is to the best of HAT knowledge, correct at the time of publication, but it reserves the right to change the same.


OTHER SENSITIVE AND PATINENT ISSUES

RISK, TRAVEL INSURANCE, LIABILITY

(i) HAT and associated companies make arrangements for hotel/lodge accommodation, for transport and conveyance by whatever means, as agents for passengers on the condition that they shall not be liable for any injury, damage, loss, accident, delay or irregularity which may be occasioned by reason of any defect in any vehicle, or through the acts or defaults of any company or person engaged in conveying the passenger or in carrying out the arrangements of the tours, or otherwise in connection therewith, or of any hotel/lodge proprietor or servant. 

(ii) HAT and associated companies accept no responsibility for losses or additional expenses due to delays, or changes, in train, steamer, motor, or other services, sickness, weather, strikes, civil disturbances, war, quarantine or other cause. All such losses or expenses will be passed on to tour members as these are events beyond our control. Such conveyance etc. is subject to the laws of the country in which the tour takes place and all claims are subject only to the jurisdiction of the courts of the country in which the cause of action arises.

(iii) HAT reserves the right to employ sub-contractors to carry out all, or part, of the services provided and in the event of such right, the terms of clauses (i) and (ii) above relating to the company’s liability shall apply.

(iv) Baggage and personal effects are carried at ‘owner’s risk’ and clients are cautioned against the risk of leaving them unattended to.


LIMITS ON HAT RESPONSIBILITY

HAT its employees, shareholders, officers, directors, successors, agents and assigns (collectively HAT), does not own or operate any entity (except for HAT) which is to or does provide goods or services for your trip. It purchases transportation (by aircraft, coach, train, vessel or otherwise), hotel and other lodging accommodations, restaurant, ground handling and other services from various independent suppliers (including from time to time other affiliated HAT). All such persons and entities are independent contractors. As a result HAT is not liable for any negligent or willful act of any such person or entity or of any third person.

In addition and without limitation, HAT is not responsible for any injury, loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God or force majeure, illness, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time.

There are certain inherent risks in adventure travel of the type involved here. These include, but are not limited to, risks of white water rafting, kayaking and rafting (for example dangers of rapidly moving water, rocks and other submerged objects, hypothermia, etc), horseback riding, (for example, unpredictable behavior by the horses, being spooked, etc) hiking, walking safaris, downhill or cross country skiing, (for example, equipment failures, ice or other trail obstructions) and in all trips dangers of animals, inaccessibility to medical attention and difficulty in evacuation from remote locations in the case of a medical emergency. Passenger assumes all such risks with regard to these possibilities.

TERMS AND CONDITIONS

These terms and conditions govern the relationship between HAT and YOU, their clients to the total exclusion of any other terms and conditions. No alteration to the terms and conditions may be made by any of HAT employees, authorized representatives or agents, unless in writing by an authorized officer of HAT. All decisions and matters subject to HAT decision, shall be made by an authorized officer of HAT. Payment and reservations means that you have read and accepted the terms and conditions above.
